Terms and Conditions

Please read the following terms and conditions before placing your order. Payment of your deposit is confirmation that you understand and agree to these terms and conditions.

Quotes

  1. Quotes are valid for 14 days.

  2. Acceptance of a quote is not a guarantee of a booking/order (please refer to ‘Payments’ T&C)

  3. In the event your desired date becomes filled by another customer’s order prior to your deposit being paid, Cake Heart is not obliged to honour your quote.

Payments

  1. To secure your date, a deposit of 25% of the order total is payable. (Refer to ‘Quotes’ (3.) for more info).

  2. To speed up confirmation of your booking/order, please provide a screenshot of the bank transfer, where possible (it makes it easier for me to track all payments & provides further proof that you have paid!).

  3. Please note: Bookings/order dates are not secured until a deposit is paid & CONFIRMED.

  4. This deposit is refundable if your order is cancelled no later than 4 weeks prior to function/order date. Any cancellations less than 4 weeks prior to function/order date will forfeit the deposit.

  5. Any changes to your original order may be subject to additional charges – see section 5.

  6. Your final balance must be paid NO LATER than 1 week prior to your function/order date – failure to do so may result in your entire order being immediately cancelled.

  7. If your order is placed within 1 week of the date of your event, the full TOTAL of your order must be paid immediately to secure your booking.

  8. Payments are to be made to the account provided when T&Cs are sent via email.

Design

  1. Whilst I will do my utmost to make your cake to the design requested/photo provided, please be advised I do not usually agree to exactly duplicate other cakes. This choice is out of respect to other cake artists. Minor changes such as colour or added decorations may be used to slightly alter the original design & to ensure you have a unique, custom cake for your special event. Rest assured, I will discuss any changes or suggestions with you prior to finalising your cake design details.

  2. Please ensure you have double-checked everything on your Contract – date, flavour, name/age, colour, size, prices etc. Cake Heart is not responsible for any problems caused by discrepancies realised at a later date.

  3. Please be attentive to the fact that that whilst I can accommodate dietary requirements, my kitchen uses a wide range of allergen products, including but not limited to: nuts, eggs, dairy & gluten. It is your responsibility to ensure your guests are aware of this.

  4. Please note that colours & design of the actual cake may vary from on-screen images owing to the nature of digital & edible components.

  5. Please note Cake Heart reserves the right to use any photographs for display or promotion purposes without any compensation to you.

Delivery/Collection

  1. Orders can be picked up from my residence in Everton Hills or I can deliver to your chosen location.

  2. Pick ups & deliveries are to be at a pre-arranged time.

Pick Ups

  1. As I often have numerous deliveries & pick ups on the same day, it is imperative that you are punctual & pick up your order on time. If you are running late (or early), please contact me ASAP.

  2. If you are later than 15mins past the agreed pick up time (& have not communicated with me), I may not be available due to other commitments & deliveries & a new time later in the day may have to be scheduled for pick up.

  3. Accepting your order indicates that the order has been collected in excellent condition.

  4. You assume all liability & responsibility of the cake once it is handed over. Cake Heart is not responsible for any damage after collection.

  5. Your cake is fresh, delicate & perishable. Please handle with care.

  6. During transportation, the cake must be set on a flat level surface (ie. in the boot, floor of the car) with nothing close by that might slide/fall and damage the cake. Do not put the cake on an unstable or uneven surface.

  7. Also ensure that it is not able to slide around – I recommend the use of non-slip matting if possible.

  8. Cake Heart recommends that you transport your order with the air conditioning turned on cool. This is especially important for buttercream cakes and cupcakes. You should keep the cake box out of direct sunlight – it WILL melt if in the sun.

  9. Drive slowly, carefully, and take corners very gently. Avoid bumps and rough roads. Do not brake suddenly.

  10. Once you arrive home or at your venue, please ensure your cake is stored correctly. It is your responsibility to read the enclosed storage instructions that come with your cake.

  11. For outdoor occasions, the cake should remain in a cool, safe place, away from direct sunlight until as close to serving as possible. Please bear in mind – weather, wildlife and other situations can be damaging to your cake, and we are not responsible for problems caused by venue conditions.

  12. Indoors, the cake should be kept in a cool, dry, safe place, out of sunlight. Air conditioning is recommended, especially in Summer.

DELIVERIES DELIVERY FEE: $25 for areas within a 10km radius of Brisbane CBD, $30 for areas within an 11-15km radius of Brisbane CBD. Areas 16km & further are individually quoted.

  1. Deliveries will be made as close to the agreed time as possible. Sometimes unexpected traffic can cause delays, but I will always endeavour to contact you & inform you of any potential delays. I pride myself on punctuality.

  2. It is your responsibility to provide, clear and specific details of the delivery location. This includes address & any specific directions regarding location (description of WHERE you are located if your function is in a public space such as a park). If your event is at a professional function venue please provide details of parking for delivery (loading bays, carparks etc), & any other specific information such as functions manager contact details, which floor the function room is on, if order is to be delivered to reception desk, kitchen staff etc. Easy access to the venue must be provided, ie. close parking & elevator access to high level buildings.

  3. Where delivery has been pre-arranged, anyone at the delivery address who receives the cake is assumed to have been authorised by you. Receipt of the cake is deemed acceptance of the cake in excellent condition, and Cake Heart is not responsible for any damage after delivery.

  4. If your delivery involves cake set up by Cake Heart please note the following: The cake table must be prepared & in position in a cool safe place ready for delivery. The cake table should be level, stable, & decorated ready for the cake to be placed.

  5. Once the cake is at your venue, please ensure the cake is stored correctly. It is your responsibility to read the enclosed storage instructions that come with your cake.

  6. For outdoor occasions, the cake should remain in a cool, safe place, away from direct sunlight until as close to serving as possible. Please bear in mind – weather, wildlife and other situations can be damaging to your cake, and we are not responsible for problems caused by venue conditions.

Changes

  1. Any changes to your Contract must be notified in writing a minimum of 2 weeks prior to your event. Cake Heart endeavours to accommodate where possible, and I reserve the right to adjust the prices accordingly to reflect the changes. If there are any last minute changes, I will try to accommodate them, however this may not always be possible.

Postponement/Cancellations

  1. Please advise in writing should you need to postpone your booking. Where possible, Cake Heart will accommodate your change of date, however, this may not be possible if I am already booked out for your new chosen date. Where Cake Heart is unable to accommodate a postponement, Cake Heart reserves the right to use my discretion with regards of any refund due.

  2. Cancellations should be notified in writing as soon as possible. The Booking fee payment will NOT be refunded if cancellation is made less than 4 weeks prior to order date- refer to clause 'payment (4.)' and Cake Heart reserves the right to use my discretion with regards to any refund of other payments made.  If Cake Heart has to cancel your booking due to illness or other unforeseen circumstances, all monies paid will be refunded within 7 days to your designated bank account.

Problems

  1. I am not liable for any delays owing to and not limited to accidents, disasters, inclement weather, illness, injury or death.

  2. In the case of a problem with your cake, please contact Cake Heart immediately. I want all my customers to be happy with their order & pride myself in putting love and care into everything I create.

  3. If you have a problem with an aspect of the design, it is your responsibility to raise this issue upon receipt of the cake.

  4. If you have a problem with the bake/taste of the cake (interior), it is your responsibility to contact Cake Heart immediately & all uneaten cake must be returned on the day of the event for inspection. If you have any questions, changes or requests, please email me and I’d be happy to help.
